Termination and exit
Exit is the point of maximum risk in Indian employment, and the point at which every liability that has been quietly accruing becomes payable at once.
- Notice
- 30–90 days
- served or paid in lieu
- Final settlement
- 30–45 days
- of the last working day
- Form 16
- By 31 May
- of the next financial year
Full and final settlement covers outstanding salary, encashment of accrued earned leave, gratuity where five years have been completed, any pending reimbursements, and recovery of advances.
Abrupt termination without notice or pay in lieu carries real legal exposure in India. It is not a matter of convention.
This guide is general information about Indian employment law and practice, not advice on your situation. Rates and thresholds change. Talk to us before acting on any of it.
