Employment contracts

An Indian appointment letter is not a home-country template with the country name changed. Several clauses behave differently under Indian law, and one of them is the reason technology companies care about this page.

Intellectual property assignment must be explicit. For a company hiring engineers this is the whole point of the arrangement, and it should never be left to inference.

Post-employment non-compete clauses have limited enforceability in India and must be reasonable in scope and duration. Non-solicitation is on firmer ground.

Where someone works remotely, the contract should say so specifically. It affects which state’s rules apply to them.

This guide is general information about Indian employment law and practice, not advice on your situation. Rates and thresholds change. Talk to us before acting on any of it.
